Court Challenges Program

As our platform identifies, sex-negative policies are rife within our governments, and they harm our community. While our party's primary strategy for change is via the electoral process, we also plan vigorous legal action to obtain sexual justice. The Sex Party itself has been a victim of sexual intolerance and we have launched legal action against the provincial government's Liquor Control and Licensing Branch. See our court documents in that action. The BC Civil Liberties Association supports our stand. See their letter.

We also have commenced litigation against Canada Post. Their admail polices prohibit honest and accurate sexual information in admail. The BC Civil Liberties Assn have protested such policies. The City of Vancouver has also been giving us problems. They have indicated verbally that our Party cannot hold our SAVY event, even once or twice a year, in a private residence or office or store. They say we can only do it in a space zoned "assembly use" such as a bar or community center. Problem is, the Liquor Branch won't allow us in any bar, and community center's won't allow us access either. But we do know of private buildings which have the space, access and safety features which make them entirely suitable for a one-time annual event with 100 people or less. We regard a prohibition of such an event unreasonable and a violation of our Charter rights. We hope that their written response to our request will be more accomodating than the verbal response.

We are also contemplating taking legal action against Canadian and Vancouver laws which prohibit consensual sex work done in private homes and businesses. The criminalization of prostitution is one of the most serious human rights violations in the 21st century in Canada. We are gathering the resources to mount such a case. On Dec 21, 2005 the Supreme Court of Canada radically reformed Canadian sex laws. We agree.
